Legal terms governing your use of MyCartly Hosting services
Welcome to MyCartly Hosting! By signing up for our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, please do not use our services.

1. Services Provided
MyCartly Hosting provides shared web hosting, WordPress hosting, reseller hosting, and domain registration services ("Services"). Specific features and resource limits are defined on our Hosting Plans page.
We reserve the right to modify, upgrade, or discontinue any Service with reasonable notice to customers.
2. Eligibility & Account Registration
To use our Services, you must:
- Be at least 18 years old or have parental consent
- Provide accurate, complete, and current registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized account access
You are responsible for all activities that occur under your account, including those of any sub-users (e.g., reseller clients).
3. Billing, Payments & Refunds
3.1 Pricing & Fees
All prices are listed in Nigerian Naira (₦) and/or USD. Prices are subject to change with 30 days' notice. Renewal prices are clearly displayed before purchase.
3.2 Payment Terms
Services are billed in advance on a monthly, quarterly, semi-annual, or annual basis. Invoices are generated 14 days before the due date. Payment is due on the invoice due date.
- Late Payments: Accounts with overdue invoices will be suspended after 7 days.
- Suspended Accounts: Have 14 days to pay before termination.
- Terminated Accounts: Data is permanently deleted after 30 days.
3.3 Refund Policy
- 30-Day Money-Back Guarantee: Annual plans only. Request within 30 days of first signup. Domain registration fees are non-refundable.
- Pro-rated Refunds: Not available after 30 days.
- No Refunds: For domain registrations, add-on services, or violations of these Terms.
3.4 Payment Methods
We accept Paystack (cards, bank transfer, USSD), bank transfers, and cryptocurrency. You are responsible for any fees charged by your payment provider.
4. Acceptable Use Policy (AUP)
You may NOT use our Services for any illegal, abusive, or harmful activity, including but not limited to:
❌ Prohibited Content & Activities:
- Child exploitation material (zero tolerance – reported to authorities)
- Pirated software, warez, crack sites, or copyright-infringing content
- Phishing, fraud, or identity theft schemes
- Malware, viruses, ransomware, or malicious code distribution
- Spam, unsolicited bulk email, or email harvesting
- DDoS attacks, port scanning, or network disruption
- Crypto mining (CPU/GPU intensive mining is prohibited)
- Tor nodes, open proxies, or anonymizing relays
- Hate speech, harassment, or violent content
- Gambling or casino sites (without prior approval)
- Adult content (pornography, escort services, etc.)
Resource Usage Limits
Shared hosting is shared. You may not:
- Use more than 25% of CPU cores for longer than 60 seconds
- Use more than 1GB of RAM continuously
- Send more than 200 emails per hour per domain
- Host backup files for external servers
- Run cron jobs more frequently than every 5 minutes
If your site exceeds these limits, we may ask you to upgrade to a higher plan or optimize your code.
5. Service Level Agreement (SLA) & Uptime Guarantee
We guarantee 99.9% network uptime for all hosting plans.
Uptime Calculation
Uptime is calculated monthly, excluding scheduled maintenance (notified 48 hours in advance) and force majeure events.
Credits for Downtime
- 99.8% – 99.0%: 5% credit
- 98.9% – 95.0%: 10% credit
- Below 95%: 25% credit
Credits apply to monthly fees only and require a support ticket within 7 days of the incident.
Not Covered
- Downtime caused by customer code, plugins, or misconfiguration
- DDoS attacks targeting your specific site (we'll help mitigate)
- Third-party domain registrar issues
- Force majeure (natural disasters, war, internet backbone failures)
6. Data Backup & Loss
We perform daily automated backups of shared hosting accounts. However:
- Backups are provided "as-is" without warranty of completeness or restorability
- You are ultimately responsible for maintaining your own backups
- We recommend using our paid off-server backup add-on for critical sites
- Backups are retained for 1-14 days depending on your plan (see plan details)
- Terminated accounts have backups deleted after 30 days
7. Suspension & Termination
We may suspend or terminate your account immediately for:
- Violation of Acceptable Use Policy – Immediate suspension without refund
- Non-payment – Suspension after 7 days, termination after 21 days
- Abuse of support staff – Verbal threats, harassment, excessive tickets
- Legal requirements – Court order or government request
You may terminate your account anytime via the client portal. No refunds for partial months upon voluntary termination.
8. Limitation of Liability
To the maximum extent permitted by law:
- MyCartly Hosting is not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid us in the previous 3 months
- We are not responsible for data loss, downtime, or third-party service failures
- We do not warrant that services will be uninterrupted or error-free
9. Indemnification
You agree to indemnify and hold MyCartly Hosting harmless from any claims, damages, or expenses arising from your use of our Services, your content, or your violation of these Terms.
10. Domain Registration Terms
- Domains are registered through our partner registrars (names.co.za, etc.)
- You must comply with the relevant registry's terms (e.g., .ng NIRA rules)
- Domain fees are non-refundable once registered
- You are responsible for domain renewal – turn on auto-renewal
- We are not liable for domain expiration or loss due to non-renewal
11. Reseller Terms
Resellers are responsible for:
- Their own clients' compliance with our Acceptable Use Policy
- Providing support to their own clients (we support you, you support them)
- Not overselling resources beyond their allocated plan limits
Violations by your clients may result in suspension of your reseller account.
12. Modifications to Terms
We may update these Terms from time to time. Material changes will be notified via email and/or website notice. Your continued use of our Services after changes constitutes acceptance.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through binding arbitration in Lagos, Nigeria, unless otherwise agreed.
14. Entire Agreement
These Terms constitute the entire agreement between you and MyCartly Hosting, superseding any prior agreements.
